Federal Laws, almost all employees should receive
overtime pay, as long as they work more than 40
hours a week. There are two different types of
overtime pays
- Overtime pay (usually calculated based on
eligibility and is usually between 1.5-1.8 the
regular hourly rate)
- Double pay (when eligible, the employee receives
double the pay rate)
Note In California, double rates must be paid
for all hours worked in excess of 12 hours in any
workday, and for any hours worked in excess of
eight on the seventh consecutive day of work (in

The general rule is that if you are earning less
than 455 per week, you are eligible to receive
overtime pay. If you are earning more than 455
per week, you are classified as an exempt
employee, and ineligible to receive overtime
pay.

overtime pay. These professions involve
- Taxi driving
- Truck driving
- Working in sales
- Working on a radio or television station
- Working In a small open market

6How is Overtime Pay Calculated
Most people believe that working on a Saturday
will grant you overtime pay. That is not true, as
overtime pay is usually given to those who work
more than 40 hours a week. Essentially, if you
are earning 10 per hour and have worked 55 hours
this week, you will be paid the regular 40 hours
per 10 an hour, and an additional 15 hour at 15
an hour. In the majority of states, the overtime
pay is 1.5 times the regular hourly rate.
7There are some exceptions. For instance, medical
personnel may work 30 hours in one week and 50
hours the next week. That is still considered a
40-hour week, and that individual will not be
entitled to overtime pay. Some professions are
different than others, but as long as you average
40 hours a week in a months period, you are not
