How can you stop student loan tax garnishment?
  • After missing one payment, a student loan will be
    considered late. Your loan will be declared in
    default if you keep missing your payments for
    more than 270 days (for federal student loans) or
    120 days (for private student loans).
  • Student loan default can have severe
    consequences. If you default on federal student
    loans, your tax refund may be withheld. This
    process is known as Treasury offset (sometimes
    called tax garnishment). It is important to
    address a student loan default immediately.
    However, you should take steps before filing
    taxes to avoid having your refund withheld.

  • Private refinancing
  • Refinance student loans is when you pay off your
    existing loans and take out a private student
    loan. This will leave you with only one loan to
    manage. Refinancing may offer you a lower
    interest rate depending on your credit score.
    This could help you save money and pay down your
    loans more quickly. This way you can avoid to be
    default student loan garnishment and tax refund.
  • Federal consolidation
  • You can also consolidate federal loans into one
    Direct Consolidation loan to avoid default.
    Federal student loan consolidation will not lower
    your interest rate but you can increase your
    repayment term by up to 30 years. This could
    significantly reduce your monthly payments.

  • The Treasury Offset Program will notify you if
    your tax refund is being garnished. This notice
    must be received at least 65 days prior to the
    offset. You will be notified by the Treasury
    Offset Program (TOP) about what you can do to
    stop or dispute the offset.
  • For your student loan that has been defaulted,
    set up a rehabilitation plan.
  • Ask for a copy and inspection of your records.
  • Object to the offset.
