4Eligibility Entitlement
- Only the following entities may authorize
transfer of benefits - Secretary of Defense (when the Coast Guard is
operating as a service of the Navy) - Secretaries of Army, Navy, or Air Force
- Secretary of Homeland Security (for Coast Guard)
- PHS/NOAA members are not eligible for TOE
- Reminder VA does not determine eligibility for
transfer of entitlement.

5Eligibility Entitlement
- To be approved to transfer entitlement
individuals must - Be in Armed Forces on 08/01/09,
- Have completed 6 years in the Armed Forces, and
- Agree to serve 4 more years
- DoD/DHS has finalized rules to address situations
when individuals cannot (by military rules or
retirement) serve 4 more years after 08/01/09. - Note Armed Forces includes individuals on
active duty as well as individuals in the Reserves

- Final Rules
- Individuals eligible for retirement on 08/01/09
are not required to serve any additional service - Individuals with an approved retired date after
08/01/09 and before 07/01/10 are not required to
serve any additional service - Individuals eligible for retirement after
08/01/09, but before 08/01/10 are required to
serve 1 additional year of service. - Individuals eligible for retirement between
08/01/10, and 08/01/11 are required to serve 2
additional years of service. - Individuals eligible for retirement between
08/01/11, and 08/01/12 are required to serve 3
additional years of service.
7Eligibility Entitlement
- An individual approved to transfer benefits may
- Transfer up to 36 months of benefits (unless
DoD/DHS restricts number of months an individual
may transfer). - Revoke or modify a transfer request of any unused
benefits unless the transferors 15-year
eligibility period has ended. - Transfer to spouse, children, or both in any
amount up to amount transferor has available or
amount approved by DoD/DHS.
8Eligibility Entitlement
- An individual approved to transfer benefits may
not - Transfer benefits to a new dependent once the
transferor is no longer a member of Armed Forces. - Note A member of the Armed Forces includes
individuals on active duty as well as individuals
in the Reserves.
9Eligibility Entitlement
- Children
- In order to transfer entitlement children must
be - Unmarried and have not reached the age of 18 or,
- In school and have not reached the age of 23
- May use benefits after transferor completes 10
years in Armed Forces - In order to use benefits, children must have
- Reached age 18 or
- Completed requirements of secondary school
diploma (or equivalency certificate) - May use until 26 years old, even if transferors
15-year eligibility period ended, unless
transferor specifies an earlier ending date - May continue to use benefits after marriage
10Eligibility Entitlement
- Spouses
- May use after transferor completes 6 years in
Armed Forces - Can continue to use benefits if divorced, unless
the transferor revokes remaining entitlement - Can use benefits up to transferors 15-year
eligibility period, unless transferor specifies
an earlier ending date
11Eligibility Entitlement
- If the transferor fails to complete the service
agreement, the transferee(s) will no longer
retain eligibility for TOE unless the transferor
did not complete their service agreement due to - Death
- Condition that Existed Prior to Service (EPTS)
- Hardship
- Condition that Interfered with Duty (CIWD)
- Disability
- Reduction in Force (RIF)

12Where Does the Process Begin?
- Service members apply for transfer of entitlement
- through DoDs Transfer of Education Benefits
(TEB) website.

16 - DoD determines eligibility for TOE, not VA.
- Once eligibility has been approved through the
TEB website, eligibility information will be
displayed in Veteran Information Solution (VIS). - VIS will be used to verify TOE eligibility that
has been approved through TEB website. - Reminder Service members must apply and be
approved through the TEB website before VA can
issue a TOE Certificate of Eligibility to a child
or spouse.

17- Changes made while the service member is still in
the Armed Forces - Can be entered in the TEB website by the service
member - If entered, will be displayed in VIS
- Can be reported directly to the VA
- Changes made after an individual has left the
Armed Forces - Will be limited to transferees designated while
the service member was still in the Armed Forces - Cannot be entered in the TEB website

reviews VIS for TOE data - If TOE data is displayed in VIS, the application
for transfer of entitlement can be processed.

data is displayed in VIS, VA will review the
claim for qualifying Post-9/11 service - If no service exists, VA will disallow the claim
- If service exists, VA will review for potential
TOE eligibility - A minimum of 6 years of service

- Children Always receive the veteran rate,
including the monthly housing allowance books
and supplies stipend, even if transferor is on
active duty - Spouses Paid the same rate the transferor would
receive - Cannot be paid monthly housing allowance or books
and supplies stipend if the transferor is on
active duty - Not limited to the highest in-State tuition and
fee rates while transferor is on active duty - Note Veteran rate is based on the benefit level
the service member would be entitled to if their
RAD date was the first day of the enrollment
period.

Joe entered on active duty June 26, 1998. He is
currently serving on active duty and transferred
12 months of chapter 33 entitlement to his wife
Mary. She is enrolled in 12 credit hours for the
Spring 2010 term at John Hopkins University. Her
tuition is 25,000.00, and her fees are
5,000.00. What benefits is Mary entitled to
while she attends John Hopkins University for the
Spring 2010 semester?

Mary will be paid the active duty rate because
Joe is currently on active duty. John Hopkins
University will receive 30,000.00 on behalf of
Mary for the Spring 2010 term. 25,000.00

Individuals on active duty are not entitled to
those benefits payments.

University. Her tuition is 25,000.00, and her
fees are 5,000.00. What benefits is Sue entitled
to while she attends John Hopkins University for
the Spring 2010 semester?

She will be entitled to the tuition and fees
charged or, the highest in-state tuition and
fees, whichever is less. John Hopkins University
will receive a total of 6604.56 on behalf of Sue
for the Spring 2010 term. Highest in State

- Individuals are encouraged to apply using VA Form
22-1990E, Application for Family Members to use
Transferred Benefits - The hardcopy and VONAPP version are available on
the GI Bill website. - Reminder A signature is not required in
support of applications for education benefits or
applications for a change of program or place of
training

Reminder Individuals approved for TOE are
eligible for all programs at an IHL (including
NCD programs). If the transferor relinquished
chapter 30, 1606, or 1607 the transferee will
also be eligible for programs not authorized
under chapter 33.

- Overpayments
- Overpayment processing will be available in Phase
3. - Phase 3 includes functionality for adjustments
and terminations.

- Six credit hour exclusion still applies to first
withdrawal or drop - Transferor and the transferee will be jointly
responsible for all overpayments. - A debt will be created on both records in the BET
and will be recouped from all payments processed
until the debt is liquidated.
