What is GI?
  • An indication which identifies goods as
    agricultural, natural or manufactured goods as
    originating or manufactured in the territory of
    country or a region or locality in that territory
    where a given quality, reputation or other
    characteristic of such goods is essentially
    attributable to its Geographical origin.

Why the GI needs Protection?
  • Consumers Point-
  • GIs are denoting quality and origin of the
    products. If not protected properly many of the
    GIs which have acquired reputation and good will
    could be misrepresented by unscrupulous
    commercial operators.

  • Producers point-
  • Producers of genuine GI products suffer damage
    because their valuable business is taken away
    from them and their long standing reputation and
    goodwill are spoiled.

  • To prevent it from becoming generic.

  • No obligation to protect G.I which are not or
    ceased to be protected in the country of origin
    or fallen in to disuse.

How the GI can be Registered?
  • Application for the registration can be made at
    GI registry located at Chennai.
  • The Registrar of GI.
  • Geographical Indications Registry,
  • Intellectual property Office Building.
  • Industrial Estate, GST Road,
    Guindy,Chennai-600 032.

Who can Register?
  • Association of persons or producers.
  • Organization or Authority established under any
    law for the time being in force representing the
    interest of the producers.

How to apply?
  • Application for registration of a GI should be in
    the prescribed form (GI-1A to 1D). Accompanied by
    the prescribed fee Rs.5000/- Per Class.
  • It must be made in triplicate along with three
    copies of a statement of case accompanied by five
    copies of additional representations.

Statement of case
  • A statement as to -
  • How the GI serves to designate the goods as
    originating from the concerned territory in
    respect of specific quality, reputation or other
    characteristics.
  • The standards benchmark for the use of the GI
  • The industry standard as regards the production ,
    exploitation, making or manufacture of the goods
    having specific quality reputation, or other
    characteristics of such goods that is essentially
    attributable to its Geographical origin
  • With the detailed description of the human
    creativity involve , if any or other
    characteristics.

Statement of case
  • The particulars of the mechanism to ensure that
    the standards, quality, integrity, and
    consistency, or other special characteristic are
    maintained by the producers, or manufacturers of
    the goods
  • An affidavit as to how the applicant claim to
    represent the interest of the concerned persons
    , producers, authority or organizations.

  • Three certified copies of the map of the
    territory , or region .
  • The particulars of human skills involved or
    uniqueness of the Geographical environment or
    other inherent characteristics of the GI.

  • Name and address of the applicant and Agent if
    any.
  • Specification and class of goods .
  • Period of use.

  • Brief description about the origin and the
    evolution of the GI.
  • Documentary proof
  • Gazettiers
  • Authentic Texts

  • Manufactured goods.
  • Agricultural goods.

  • Peculiar features that makes the GI different
    from other similar goods.

Signing of the Application
  • Association
  • Authorized Signatory
  • Body corporate/Organisations /Authority
  • Chief executive , M.D , Secretary, or
  • other Principle Officer.
  • Partnership At least one of the partners

Payment of Fees
  • Cash
  • Money Order
  • Bank Draft
  • Cheque
  • Draft and Cheque shall be payable to the
    Registrar of GI at Chennai.

Validity of Registration
  • Registration is valid for 10 Years.
  • Registration can be renewed there after.

Benefit of Registration
  • Authorized user gets the exclusive right to use
    .
  • The Registered Proprietor and Authorized user
    gets the right to seek relief with respect to
    infringement.
