  • Age Discrimination occurs when ageism is
    applied upon an older person where rights and
    privileges are denied solely on the basis of age

State Interpretation of the Law
  • According to the Age Discrimination in Employment
    Act, employers with 20 or more employees may not
    discriminate against workers age 40 and older in
    recruitment, hiring, training, promotion, pay,
    benefits, firing, layoffs, retirement, and any
    other aspect of employment because of age.
  • Utah-the minimum number is 15, but an estimated
    76 to 87 of employers in Utah employed less
    than 15 people in 2001

  • 17,000 cases a year are filed to the EEOC
    claiming age discrimination, but only a few
    strategically targeted cases are answered
