  • Who is responsible?
  • The new laws require all parties in the supply
    chain to manage the causes of heavy vehicle
    driver fatigue.
  • If your actions, inactions or demands cause or
    contribute to road safety breaches then you may
    be legally accountable.
  • Authorities can investigate along the supply
    chain and corporate chain of command.

2. National Chain of Responsibility Law
  • The new law falls within the requirements of
    Chain of Responsibility for all businesses
  • Parties in the Chain of Responsibility (in
    addition to the driver) include
  • employer of a driver (up to Director Board
    level)
  • prime contractor of a driver
  • operator of a vehicle
  • scheduler of goods or passengers for transport by
    the vehicle and also the scheduler of the driver
  • consignor and consignee of the goods
  • loading manager and
  • loader and unloader of the goods

  • OHS reforms have redefined fatigue as a
    workplace hazard.
  • Management
  • Responsible for preventing excessive duration of
    wakefulness at work and inadequate sleep
    opportunities between shifts.
  • Employees
  • Responsible for using time between work periods
    to obtain sufficient sleep. Employees must notify
    the company if this does not occur.
  • Management
  • Responsible for providing clear guidelines on
    how to manage an insufficient sleep/excessive
    wake incident
