Introduction
  • To give effect to Governments policy on minerals
    and mining, the following three pieces of
    legislation will be introduced into Parliament
  • Minerals and Petroleum Resources Development Bill
    (formerly Minerals Development Bill)
  • Precious Metals and Diamonds Bill and
  • Mining Titles Registration Act.

    the revised version of draft Bill
  • International panel of experts has given positive
    comments
  • State law advisors participated in drafting
    process
  • On recommendation of state law advisors new
    Precious Metals and Diamond Bill being drafted

  • 22/08/2001 Submitted Bill to Cabinet Committee on
    the Economic Sector -
  • 12/09/2001 -Bill was discussed at Cabinet
    Committee on Governance and Administration
    (delayed because of Racism Conference)
  • 19/09/2001 - Cabinet approved introduction of
    Bill into Parliament
  • 26/09/2001 - Referred draft Bill to State law
    advisors for certification

    in Government Gazette (Rule 241)
  • 26/10/2001 - Introduce draft Bill into Parliament

Precious Metals and Diamond Bill
  • The purpose of the Bill is to regulate the trade
    in and possession of precious metals and
    diamonds
  • To discourage trade in conflict
  • Promote beneficiation of these minerals.

Mining Titles Registration Act
  • This is an extensive amendment to existing
    Mining Titles Act, 1967
  • Important in relation to security of tenure and
    registrability of rights and
  • It is one of the corner stones for the successful
    implementation of the Minerals and Petroleum
    Resources Development Bill.

  • February 2002 - Seek Cabinets approval for
    release draft amendments for public comment
  • June 2002 - Obtain Cabinets approval for
    introduction of amendment into Parliament
  • July 2002 - Refer draft amendments to state law
    advisor for certification
  • August 2002 - Introduce draft amendments into
    Parliament.
