Who is covered by the code?
  • The Employment Standards Code applies to
  • Part time workers
  • Full time workers
  • Casual, temporary student workers
  • Commissioned sales staff
  • Salaried workers
  • Pieceworkers
  • The code does NOT cover
  • Out of province, inter-provincial employees
  • Employees covered by other Acts
  • Employees who fall under Federal Jurisdiction
  • Collective Agreements

What are Wages?
  • Salary, Pay, Commission or any other
    Remuneration, no matter how it is calculated.
  • Does NOT include
  • Tips,
  • Expenses
  • Unearned Bonus
  • Wages
  • May be paid by Direct Deposit
  • Must be paid to employee by Cash, Cheque or Money
    Order
  • Greater Benefits can be enforced
  • Wages can be reduced by notifying employee prior
    to pay period which the deduction is to take
    place.

More on Wages
  • Pay Periods
  • No longer than one month
  • Payment within 10 days of end of pay period
  • Wages following termination
  • If an employee quits with no notice, wages are
    held for a period of notice (usually 2 weeks)
    plus an additional 10 days
  • If adequate notice is given, wages must be paid
    within 3 days
  • If no notice is required, wages must be paid
    within 10 days.
  • Minimum Wage
  • Effective October 1, 1999 minimum wage in Alberta
    is 5.90 per hour (regardless of age ie. No
    separate minimum wage for students anymore)
  • Some salespersons - 236/wk
  • If an employee arrives for a scheduled shift and
    is sent home for any reason, the employee is
    entitled to 3 hours show up pay at the minimum
    wage.

  • Employment Insurance
  • Canada Pension (age requirement)
  • Alberta Health Care
  • Garnishee (wages withheld due to a court order
    for payment of unpaid bills)

  • Payroll records must include
  • Name, address, birthdate
  • Overtime agreements
  • Time off for O.T. taken
  • Vacations taken dates pay
  • Deductions, reason amount
  • General holiday dates and pay
  • Hours of work recorded daily
  • Wage O.T. rates changes
  • Wages O.T. paid
  • Dates of employment
  • Parental Documents
  • Termination
  • Notice of pay
  • All the above payroll records must be kept in
    Alberta for 3 years.
  • Your Pay Statement must include
  • Regular and O.T. (overtime) hours of work
  • Wage Rate and O.T. rate
  • Earnings paid, itemized
  • Deductions, amounts and reason
  • Time off instead of O.T.
  • Period of Employment covered.
  • No Deductions are permitted for
  • Cash shortages
  • Faulty workmanship

Hours of Work Overtime
  • No more than 12 hours in a day - inclusive of all
    breaks UNLESS
  • Accident
  • Urgent work
  • Unforeseeable emergency
  • Shift Changes
  • 24 hours notice in writing
  • 8 hours of rest in between shifts
  • Rest
  • 1/2 hour break for every shift in excess of 5
    hours
  • Days off - one day of rest/week, may be
    accumulated up to 4 weeks, then 4 days off
  • Overtime Hours
  • After you have worked 8 hours in a day or 44
    hours in a week, any work after that is
    considered overtime.
  • Overtime Pay is time and one-half
  • Exceptions to this overtime rule is
  • True Managers/Supervisors
  • Employees exempted by Regulation

  • Legislated holidays in Alberta
  • New Years Day (Jan)
  • Alberta Family Day (Feb)
  • Good Friday (Mar or Apr)
  • Victoria Day (May)
  • Canada Day (Jul)
  • Labour Day (Sept)
  • Thanksgiving Day (Oct)
  • Remembrance Day (Nov)
  • Christmas Day (Dec)

Qualifying for Holidays Pay
  • To Qualify for General Holidays, the employee
  • Must have worked 30 days in the 12 months
    preceding the Holiday
  • Must not refuse to work on Holiday (in other
    words, if you want a holiday at a certain time,
    it is a wish abided by the employer and not time
    you absolutely cannot/will not work - then it
    becomes time off without pay)
  • Must work the scheduled shift before and
    scheduled shift following Holiday
  • Pay for General Holidays
  • An amount at least equal to average daily wages
  • An amount at least 1.5 times wages for each hour
    worked on that day
  • Pay for General Holidays - Option 2
  • An amount at least equal to wage overtime rate
    if overtime worked and one day off
  • To be taken no later than next annual vacation
  • Taken on normal day of work
  • Paid at amount at least equal to average daily
    wage
  • Pay for Gen. Holiday worked where it is NOT
    Regular day of work
  • Employee paid time and a half

WHAT? Youre Quitting?
  • Termination by Employee
  • Youve worked there more than 3 months? You need
    to give 1 week notice
  • Youve worked there more than 2 years? You need
    to give 2 weeks notice
  • Termination notice is not required if
  • Personal health or safety is compromised
  • Unpreventable circumstances
  • Wages reduced
  • Termination by Employer
  • Over 3 months? 1 week notice
  • 2 years? 2 weeks notice
  • 4 years? 4 weeks notice
  • 6 years? 5 weeks notice
  • 8 years? 6 weeks notice
  • 10 years? 8 weeks notice
  • EXCEPTIONS Termination Notice (such as Just
    Cause, Seasonal Work, Construction Worker,
    Temporary lay off)
