1
CRITERIA FOR STALKINGThese five things must be
present to ensure a conviction of stalking
  • Reasonableness would a reasonable person be
    uncomfortable with the behavior?
  • Repeated
  • What effect is it having on the victim? No matter
what the intention of the stalker is, if it is
making the person feel uncomfortable or
    intimidated, it is stalking.
  • Is the offender and the displayed behavior easily
    avoidable?
  • Was the person accused of stalking made aware
    that they're behavior was unwanted?

2
Prevalence of Stalking
  • 13 of women reported being victims of stalking.
  • 4 out of 5 know their stalker. 43 are stalked by
    a boyfriend or ex-boyfriend.
  • 30 are stalked only off campus. The remaining
are stalked either only on campus or both on
    off campus.
  • Nearly 78 of women report being telephoned by
their stalker, 42 report being followed by their
stalker nearly 25 report being emailed by
    their stalker.
  • 35 of stalking incidences end in violence.
  • 25 of stalking victims obtain restraining
orders in 2/3 of these cases, the restraining
    order is violated.
  • About 50 of all stalking cases are reported to
the police 25 of these result in an arrest.

WHAT TO DO IF BEING STALKED
  • Use the XYZ formula
  • X The behavior (When you keep calling me)
  • Y How it is effecting you (It makes me feel very
    uncomfortable)
  • Z What you would like to have happen (so dont
    call me again).
  • Notify law enforcement. Stalking should not be
taken lightly. There is a very good potential for
violence if nothing is done to break the stalking
    sequence.
  • Don't make idle threats. If you say you're going
to notify the police, do it.
  • RECORD EVERYTHING write down everything that
happens, when it happens, what you did about
    it.
  • Log calls visits, save letters, answering
    machine tapes, etc.

WHAT TO DO
  • Tell the stalker "no" only once, then never
satisfy them with a reaction again.
  • Get a dog, "one of the least expensive but most
    effective alarms."
  • Restrict access to your home address telephone
number. Get a cell phone keep it with you at
    all times.
  • If the stalker gets your home telephone number,
dont change it, let the machine pick-up.
Whenever you close off one avenue for a stalker,
they will find another it could easily be
worse. Give your new cell number, to everyone but
    the stalker.
  • Document everything (make a log save evidence
    like letters)
  • Have co-workers roommates screen all calls
    visitors.
  • Dont accept unordered packages destroy
    discarded mail.
  • If a car continues to follow you, drive to the
nearest police station, never home or to a
    friends house.
  • Acquaint yourself with 24 hour, populated places
    in your area.
  • Consider moving if your case warrants it.
  • Dont be embarrassed or think you caused this
    somehow.

6
Types of Stalkers These are broad categories
may overlap
  • Intimate partner stalkers refuse to believe a
relationship has really ended. Studies show most
arent sympathetic, lonely people who are still
hopelessly in love, but were in fact emotionally
    abusive controlling during the relationship.
This category accounts for 50 of stalkers.
  • Delusional stalkers frequently have had little,
if any, contact with their victims. Major mental
    illnesses like schizophrenia, manic-depression or
erotomania are common. Some studies show these
are the most tenacious of all stalkers.
  • In erotomania, stalkers actually believe theyre
in a relationship with their victim, even though
they might never have met. Lasts an average of 10
    years.
  • Another type might believe theyre destined to be
with someone. They know they arent having a
relationship with their victim, but firmly
    believe they will some day.
  • Theyre both threatened by yearn for closeness
they often pick victims who are unattainable in
some way. What they cant attain in reality is
achieved through fantasy for this reason the
delusion seems to be so difficult to relinquish
Even an imaginary love is better than no love at
    all.
  • Vengeful stalkers typically become angry with
their victims over some slight, real or imagined.
They all stalk to "get even.
  • Includes psychotics, former intimate partner
    stalkers delusional stalkers can become
vengeful for a variety of reasons. (restraining
    orders, or marriage).
  • In general, the less of a relationship that
actually existed prior to the stalking, the more
    mentally disturbed the stalker.
