Outcome of the Regulatory Approach
  • Set of subjects for prescriptions in the IR
  • High level requirements in the IR detailed
    technical requirements in Specification
  • IR Community Spec. necessary to ensure
    interoperability
  • No reference in the IR to Specification

    state a/c)
  • a/c flying for testing, delivery and maintenance
    purposes

20
Timescales
21
Data link communications
  • ANSPs shall ensure that ground systems support
    air ground communications based on
  • ATN VDL-2
  • Or other MoC fulfilling specific conditions
    (specified in the IR)
  • Data exchanges with all equipped aircraft (flying
in the airspace under their responsibility)
  • Operators shall ensure that airborne systems
support air ground communications based on
  • ATN VDL-2
  • Or other MoC fulfilling specific conditions
    (specified in the IR)
  • Data exchanges with all ATS units (which may
    control these flights)

28
Main Results of the Formal Consultation
  • IR Points which were widely accepted
  • List of main issues raised by formal consultation

29
IR Points widely accepted
  • The scope structure of the IR
  • The four proposed data link services
  • Air ground communication services based on
ATN/VDL2 as a minimum on the ground
  • Openness to other technologies in addition to
    ATN/VDL2
  • Deployment of data link services above FL285 in
the whole SES airspace by Feb 2016
  • The level of details of IR requirements
  • The need for a Specification
  • Air ground communication services can be
    provided by certified and/or non-certified
    organisations

30
Main issues raised by comments /1 Deployment of
data link services
  • Aircraft equipage
  • Which aircraft should be equipped
  • Which dates for aircraft equipage (forward fit,
    new fit, retrofit ..)
  • Data link recording of data link messages
  • Incentives

31
Main issues raised by comments /2 Deployment of
data link services
  • Aircraft exemption
  • FANS-equipped aircraft
  • FANS-equipped aircraft delivered before Jan 2014
    are exempted for their lifetime
  • When a standardised solution for FANS/ ATN
convergence is available, a new Regulation should
    be developed
  • FANS accommodation by ACCs
  • Old long haul aircraft should be exempted
  • Old regional aircraft should be exempted
  • Aircraft planned for cease of operations 3 years
after the retro fit period should be exempted

32
Main issues raised by comments /3 Deployment of
data link services
  • State aircraft
  • Very few comments relating to State aircraft
  • Amendment to the definition of transport type
    state aircraft
  • Applicability of the IR to non-EU State aircraft
    (DoD)

33
Main issues raised by comments /4 Deployment of
data link services
  • Ground deployment timescale
  • T0, Step 1, data link services operational in
    core area FLgt285
  • Some ANSPs accept the proposed date Feb 2011
  • A few ANSPs consider this date as non acceptable
and propose significant delays for Step1
  • T1, Step 2, data link services extended to the
    SES airspace FLgt285
  • No question about the proposed date Feb 2016

34
Other issues raised by comments /1
  • Data link services/ communications
  • Definition of data link services based on ED 120
must not mandate the implementation of the full
    set of messages elements
