Sexual Harassment

• A form of sex discrimination that involves
  unwelcome sexual advances, requests for sexual
  favors, and other verbal or physical conduct of a
  sexual nature.

3 Elements of Sexual Harassment

• It must be unwelcome.
• It must be sexual in nature.
• It must occur in or impact the work place.

Unwelcome

• Unwelcome behavior is behavior that a person does
  not ask for and which that person considers
  undesirable or offensive.

Sexual in Nature

• Behavior which is sexual in nature is fairly easy
  to determine. Telling sexually explicit jokes,
  displaying sexually suggestive pictures, talking
  about sex are obviously sexual in nature.

Work Environment

• For sexual harassment to occur, the unwelcome
  behavior must occur in or impact on the work
  environment.

Ranges of Behaviors

• Green Zones
• Yellow Zones
• Red Zones

Green Zone

• Behaviors that are NOT sexual harassment.
• Handshake
• Counseling on military appearance or conduct.
• Showing concern or encouragement in a reasonable
  manner.

Yellow Zone

• Yellow means Caution
• Others would find unacceptable.
• Unwelcome behavior is repeated after told
  offender has been told the behavior is
  unacceptable

Red Zone

• STOP
• Behavior that is always sexual harassment.
• Sexual Favors
• Threats
• Sexual images.

Sexual Assault

• Rape
• Sexual intercourse by a person, executed by force
  and without consent of the victim. It may be
  committed on a victim of any age. Any
  penetration, however slight, is sufficient to
  complete the offense.

• Date Rape
• Rape is not always between strangers. Sometimes
  rape may occur in several forms while on a date
  with someone known by the victim.

Assault

• An unlawful physical attack upon another an
  attempt or offer to do violence to another.

Hazing

• Hazing is a ritualistic test and a task involving
  harassment, abuse or humiliation used as a way of
  initiating a person into a gang, club, military
  organization or other group. The definition can
  refer to either physical (sometimes violent) or
  mental (possibly degrading) practices. It may
  also include nudity or sexually oriented
  activities.
