  • Sec. 3 (b)(1) A nonresidential project shall
  • (A)(i) Be designed to achieve 75 points on the
    EPA national energy performance rating system . .
    . and be benchmarked annually using the ENERGY
    STAR Portfolio Manager benchmarking tool . . .
  • (ii) . . . Benchmark and Target Finder
    scores and ENERGY STAR statements of energy
    performance for each building shall be made
    available to the general public within 60 days
    after they are generated . . .
  • (C)(ii) Nonresidential projects . . . shall be
    verified as having fulfilled or exceeded the
    LEED-NC 2.2 or the LEED-CS 2.0 standard at the
    silver level.

California Breaking New Ground with ENERGY STAR
  • All state buildings to be benchmarked using EPA
    energy performance rating and Portfolio Manager
    by end of 2007.
  • California AB 1103 became law in 2007.
  • By January 1, 2009, upon the request of any
    commercial building owner, requires all utilities
    to make available data for uploading into
    Portfolio Manager.
  • By January 1, 2010, requires the disclosure of an
    ENERGY STAR rating and energy use data as part of
    commercial real estate transactions involving the
    sale, lease, or financing of a whole building.
