Tow Trucks in Emergency Relief

• Situation
• Fines are being issued for exceeding axle weights
  when providing emergency support
• Federal regulations currently exempt tow trucks
  responding to emergencies, under 49 CFR 390.23
  and 23 CFR 658.23.
• To avoid citations operators are now responding
  with smaller vehicles to stay within weight
  requirements, resulting in unsafe operation.

• Recommendations
• Clarify state implementation of the emergency
  vehicle exceptions as they apply to Tow Trucks.
• Improve communication between law enforcement and
  weigh station operators
• Review annual permitting process to ensure safe
  towing formulas are considered in permitting
  decisions.

Hook and Ladder Fire Trucks

• Situation
• Large aerial ladder trucks exceed tandem axle
  weight limits.
• Once placed in service, fire departments are
  allowed to operate these overweight vehicles.
• Large aerial ladder trucks en route to purchasing
  fire departments are being denied permits in some
  states, forcing delivery via flatbed trailer.
• This increases cost to municipality, as much as
  5,000 per vehicle, and can pose a barrier to the
  demonstration of new vehicles.

• Adjust state permitting process to allow delivery
  and demonstration of such trucks to fire
  departments.
