GED (General Environment Duty)
  • While dealing with contaminated land, one must
    meet the GED and gain permits that may be needed
    to carry out the removal of contaminated soil or
    conduct development on the land. Everyone must
    have a GED as per the Environment Protection Act
    (EP) 1994 to avoid carrying out any activity that
    might be causing contamination.

Duty of Notification
  • Persons who must notify include
  • Occupier or owner
  • Commissioned auditor
  • Local government official
  • A person with suitable qualifications has to
    notify authorities or his employer about any
    occurrence of events related to contaminated
    land. Next, the owner/ occupier should notify.

Changes or a Removal in Land Registers
  • In case one wants to remove land from registers
    like CLR and EMR, one must submit an
    investigation document that demonstrates that
  • No ongoing activity that must be notified is
    being carried out on the land.
  • There is no contamination of land which suits any
    land use.
  • In case the land or its uses change or need
    updating, one must submit the document of
    contaminated land investigation.
