What is professional accountability?
  • Safe nursing practice requires an understanding
    of the legal and ethical framework within which
    nurses must function.
  • Students practice, under supervision, at a
    standard deemed reasonable for their level of
    knowledge skills

Sources of LawThere are two sources of law in
Australia
  • Parliamentary Law or Legislation
  • Federal Legislation i.e. Health Insurance Act
  • State/Territory Legislation i.e. Nursing
    Regulatory Acts are set by each State Territory

  • Common or Case Law
  • Developed in the courts and based on the
    Doctrine of Precedent
  • Two main areas are
  • Criminal Law The State must prove Beyond all
    reasonable doubt that the accused is guilty
  • Civil Law Proof is based on the Balance of
    Probabilities

Law of Torts
  • Tort a civil wrong made against a person or
    property
  • Negligence causing personal pain, damage and
    financial loss to another because of failure to
    exercise reasonable care. (Staunton, 1989).

The complainant must prove on the Balance of
Probabilities, that
  • They were owed a Duty of Care by the other person
  • That Duty of Care was breached
  • That the damage suffered, mental, physical or
    financial, was a direct result of the breach of
    Duty of Care

  • Assault and Battery Touching without consent,
    or creating in the mind of another, fear of
    unwanted contact (Wallace, 1991).
  • Any treatment given to a patient without the
    patients consent (Staunton Whyburn, 1993).
  • NB Consent to treatment or touching involves the
    patient knowing exactly what is to be done!

Where do you stand as students?
  • As nursing students you are expected to carry out
    care at a standard deemed reasonable for a
    nursing student at your level of knowledge and
    skills
  • The courts would judge your actions against what
    a reasonable student of the same level of
    education would have done

How to be accountable
  • Be aware of the laws and standards that guide
    nursing practice
  • Apply those standards to your practice
  • Be proactive and report actual and potential
    risks and hazards
  • Careful documentation

Documentation should be
  • Brief, accurate complete
  • Legible
  • Objectively written
  • Written contemporaneously or at the time of the
    incident
  • Use only accepted abbreviations
  • Know the exact meaning of terminology used
  • Draw a line through errors initial
  • Do not document care for another nurse
  • Signed
