Background
  • APT forum on Telecommunications Policy and
    Regulation hosted by Malaysia discussed the
    domain name issues and established a Consultative
    group on Regulation to further study the issues.
  • This consultative group is being chaired by India
    through S. N. Gupta, Advisor, Telecom Regulatory
    Authority of India.

Consultation paper by COR
  • The Group prepared a consultation paper and
    circulated to APT member Countries for their
    inputs.
  • Consultation paper explained the overview of the
    domain name administration and various issues
    involved.

  • Contributions were received from Hong Kong,
    Macao, Pakistan, Singapore, India, Vietnam and
    Philippines

Issues for consultation
  • What is the mechanism of domain name
    administration in a country?
  • Whether it is handled by Govt. Agency, sector
    regulator, Neutral Not-for-profit body, Service
    providers association, academic Institution or
    Private Corporation
  • Whether there is an on-going process to transfer
    the domain name registrar to a neutral body or it
    has already been achieved?
  • Is there any provision in the National
    telecommunication act or any policy document for
    addressing the Domain Name issues?

Recommendations
  • 1. Mechanism of DN Administration
  • Administrator should be a neutral non-profit
    govt. organization
  • There should be an independent arbitration agency
    to resolve disputes
  • The judgment of arbitration agency should be
    binding on the administrator
  • Eligibility for a particular domain name to be
    allocated is required to be sought from the
    applicant to prevent frauds.

  • 2. Responsibility of administration for handling
    of domain names
  • It should adopt neutral and non-profit approach
  • Allocation should be non-discriminatory
  • The fees for this purpose should be minimum so
    as to just recover the cost of administration
  • Governments of respective countries should take
    initiative to establish such administrative
    agency

  • 3.Provisions in the national policy documents  
    In most of the countries there is no explicit
    provision in respect of administration of domain
    names in their sector policy documents.
  • Therefore, it is recommended that establishment
    of such body should be done through a
    administrative order by the Government.
  • 4. Further analysis by COR group will be done on
    getting the responses from other members.
