  • All information about The Unemployment Program
    and eligibility is available in the Unemployment
    Compensation Your Rights and Obligations Booklet
  • If you have difficulty understanding English,
    please be advised that information on your rights
    and obligations is available in print or on our
    website in other languages
  • You may request assistance to arrange for an
    interpreter to help you understand your Rights
    Obligations while claiming unemployment benefits

Confidentiality and Your Benefits
  • In order to ensure confidentially and identity
    protection regarding transactions with our office
    we ask that you provide
  • A picture ID to all required meetings
  • Social Security Card
  • Current Immigration status card/Alien
    verification card
  • If you wish to have someone speak to a department
    representative on your behalf, you must complete
    a confidentiality statement (every 30 days)
    authorizing that person permission to do so

Basic Eligibility
  • Must have sufficient earnings in the base period
  • Must be totally or partially unemployed
  • Must be available for full-time work
  • Must be able to perform full-time work
  • Must be actively looking for full-time work
  • Must file a timely and proper claim for benefits
  • Unless specifically exempted, must have an active
    Department work registration
  • Must participate in re-employment services if
    selected
  • Must disclose if
  • required to make child support payments
  • owe an uncollected over-issuance of food stamp
    coupons

Certain exceptions may apply to shift
requirements for an individual who is the only
adult available to care for a child under the age
of 16.

Benefit Year
  • Started the Sunday before you opened your claim
    (Effective Date)
  • Weekly Benefit Amount (WBA) does not change
    during Benefit Year
  • Maximum of 26 weeks worth of benefits in a 52
    week period (benefit year)

Base Period
  • Your WBA is based on wages earned during a Base
    Period
  • Your Base Period is determined by the wages
    reported in each quarter
  • Wages cannot be reported until the quarter has
    ended
  • Therefore we use the first four of the last five
    completed calendar quarters before your Benefit
    Year Effective Date to determine your Primary
    Base Period

What is a week?
  • Seven Days
  • Begins 1201AM Sunday
  • Ends on Midnight the following Saturday

Unemployment
  • Total
  • No work during week
  • No wages earned or payable
  • Partial
  • Working less than full-time AND Earning less
    than your WBA 30
  • You must report all gross wages for that week
    when filing your claim

Full-Time?
  • Generally 30-40 hours per week (based on what the
    employer considers full time)
  • Does not meet partial unemployment requirements
    regardless of amount earned

The Determination
  • Monetary
  • Everyone gets a monetary determination
  • Benefit Year, WBA (if there is one), Wages used
    to establish WBA
  • Non-Monetary
  • Only if necessary
  • Addresses any Issues on the claim

Appeals
  • Any Determination may be appealed
  • Appeals must be in writing (web)
  • Appeal within 14 calendar days of determination
    mail date
  • CLAIMS REPRESENTATIVE

  • If eligible usually w/determination
  • Federal standards allow 21 days to process a
    claim, we do our best to work within these
    guidelines

REMEMBER Benefits are taxable. If taxes
withheld, check is for net amount!

  • Cross match new hires, wage records and claims
  • Anonymous tips are received regularly
  • Penalties for fraud
  • Administrative and Criminal
  • Legal action/prosecution taken for fraudulent
    claims
  • Must report ALL work and gross earnings
  • Including self-employment earnings
  • Even if not getting paid right away

Work Registration Requirement
  • A full work registration is mandatory unless
    specifically exempted
  • Registration can be done
  • On the web (www.nhes.state.nh.us)
  • In the local office
  • If you received a Registration Warning today, you
    must register by midnight Saturday of the third
    week claimed for benefits, or your benefits may
    be affected

Work Registration Exemptions
  • You may be potentially exempt from work
    registration if you are
  • Involved in a Mass Temporary Layoff
  • You are a valid union member likely to find work
    through a Union Hiring Hall (card must be on
    file)
  • Involved in a strike, lockout or labor dispute
  • Documented reasonable assurance of returning to
    work with the same employer within
  • Four weeks (non-seasonal employee)
  • Sixteen weeks (seasonal employee)
  • Partially employed with most recent employer
  • Will have a new employer within 4 weeks

Vocational Training
  • Not all training is approved under unemployment
  • Your unemployment benefits may be affected
  • You must meet eligibility and receive prior
    approval to attend school or training
  • A meeting with an NHES Employment Counselor is
    required if you are enrolled or thinking about
    enrolling into a vocational, training, or
    education program

Please contact your local office to set up a
meeting with an Employment Counselor to discuss
training.

Reemployment Seminars (ERI)
  • Three dynamic seminars are available to
    assist you with your work search
  • Sign up with the Receptionist or
    with your Case Manager
  • A Case Manager may require you to attend one or
    more of these seminars
  • Failure to attend a scheduled seminar may affect
    your unemployment claim

What do I do whenI find a job?
  • Notify the Local NHES office or the Benefit
    Adjudication Unit
  • Enter gross earnings for the first week you
    worked, if you did not work a full week
  • Make sure you have claimed all the weeks for
    which you may be eligible
  • Do Not throw away completed Work Search Logs

  • To help eligible persons receive all unemployment
    compensation due to them as quickly and
    accurately as possible, and to assist individuals
    successfully return to work as soon as possible.
