40 General supervision The supervision of
avoidance, recovery and disposal of waste is
subject to the responsible authority. The waste
producers, The waste carriers and the waste
management and operating companies have to
provide the information to the responsible
authorities.

6Proof Procedure (1)
- Proof requirements
- The competent authority is authorised to take the
decision concerning the type, extent and content
of the required documentation - Before the commencement of the planned disposal

The proof procedure is mandatory concerning the
disposal and recovery of waste requiring special
supervision Art. 43(1) / Art. 46 (1) or (2)

9Record of Proper Waste Management (1)
Waste producer shall furnish proof of the
permissibility for a planned management operation
for waste requiring special supervision
- The Record of Proper Waste Management shall
consist of - Cover Sheet (EN)
- Declaration of Responsibility (VE) waste
producer - Declaration Analysis (DA) waste management
company - Declaration of Acceptance (AE) waste management
company - Confirmation (C) competent authority

11Collective Record
Art. 8 Collective Record of Proper Waste
Management The proof of permissibility of the
planned waste management operation can be
provided by the collector in the form of a
record of proper collective waste management
- If all the collected waste
- has the same code of waste,
- passes through the same waste management
chain, - corresponds in ist composition to the
requirements listed in the collective - record of proper waste management
- the waste collected from each waste producer
does not exeed 20 Mg - per code of waste and year.
- The collection of the waste oil is regulated in
the Ordinance on Waste Oils.
12Exemption
- Art. 13 Exemption for the Party Responsible for
Waste - Management
- The competent authority shall exempt the party
responsible for waste management partly from the
requirements of the proof procedure, if - the waste is to be treated, used for substance
recycling or energy - recovery or deposited in the facility for that
purpose (not only stored), - proper and save recovery or the compatibility of
the disposal with - the public interest are assured and
- there are no indications or known facts to
suggest that the party is - violating obligations under the proof procedure
or during operations.
13Certified Waste Management Companies
- Art 13 (5) Ordinance on Waste Recovery and
Disposal Records - Ordinance on Waste Management Companies
Owners of specialised waste management companies
shall be granted exemption if the waste
management facilities operated by them and the
treatment of waste, its use for substance
recycling or energy recovery or its deposition
in such facilities are certified.
14Proof of completed operations
- Proof of completed management operations for
waste requiring - special supervision shall be provided in the
form of consignment - notes.
- Where waste is handed over by a waste
producer, a separate set of - consignment notes shall be used for each type
of waste involved.
