Purpose of Presentation
  • To provide an overview of the approach being
    taken to implement the enhanced drivers licence
    initiative in Ontario

Context
  • The United States of America (US) is implementing
    Western Hemisphere Travel Initiative rules
    requiring all travellers entering the United
    States at land and sea border crossings to
    produce a passport or other accepted secure
    document by June 2009.
  • Ontario Position
  • Concerned that the implementation of the Land and
    Sea rules will have an adverse effect on trade
    and tourism in Ontario
  • Ontarios border crossings are vital to the
    economic growth and prosperity of Ontarios
    cities and communities
  • Want to ensure the efficient flow of legitimate
    cross-border travel and trade to maintain a
    strong economy while strengthening border
    security
  • EDL would provide a convenient alternative to a
    passport enabling expedited border clearance
    through the use of Radio Frequency Identification
    (RFID) technology
  • Other Jurisdictions
  • BC, Manitoba and Quebec are actively developing
    EDL programs. Saskatchewan and the Atlantic
    provinces are considering EDL programs
  • Neighbouring states (particularly New York)
    expect Ontario to make EDLs (and Enhanced Photo
    Cards) as widely available to its citizens, as
    soon as possible - reciprocal development for
    mutual benefit

Photo Card Act, 2008
  • The bill proposes the enactment of a new Photo
    Card Act, 2008, and related consequential
    amendments to the Highway Traffic Act
  • The proposed legislation describes three kinds of
    cards
  • A Basic Photo Card, which contains the holders
    name, photograph, and other prescribed
    information about the holder. It may be issued
    to a resident of Ontario who does not hold a
    drivers licence
  • An Enhanced Photo Card, which contains the
    information on the basic photo card but includes
    a notation that the holder is a Canadian citizen
    it is intended to facilitate border crossing
    into the US. It may be issued to a resident of
    Ontario who is also a Canadian citizen and does
    not hold a drivers licence
  • A Combined Photo Card, which constitutes the
    holders enhanced photo card and drivers
    licence. It may be issued to a resident of
    Ontario who is also a Canadian citizen and does
    hold a valid drivers licence. This card is
    commonly referred to as an Enhanced Drivers
    Licence (EDL)
  • These are voluntary programs. There is no
    obligation under this or any other act for an
    individual to have a photo card. A photo card is
    for the convenience of the holder only, and may
    be used by the holder in any situation where he
    or she wants to identify himself or herself
  • The holder of a combined photo card, however, is
    subject to the same duties as the holder of a
    drivers licence to carry, present, surrender or
    return a drivers licence as if the combined card
    were a drivers licence

Photo Card Act, 2008
  • The Act defines the purposes for which
    information may be collected and disclosed
  • The Act authorises any public body or related
    government to disclose information when requested
    by the minister for one or more of the reasons
    set out in the Act
  • MTO will disclose to CBSA only that information
    required to administer the program
  • Full Name Birth date Gender Citizenship
    Issuing Jurisdiction Issuing Country expiry
    date MRZ/OCR Unique Identifier Applicant photo
    RFID Unique Identifier Licence Status and Status
    Changes Tag Identification number (TID)
  • The authority to collect and disclose information
    is in addition to any other authority under this
    or any other act for the Ministry to collect and
    disclose information

EDL Program Features - proposed
  • Card
  • American Association of Motor Vehicle
    Administrators (AAMVA) compliant drivers licence
  • RFID tag embedded in card and Optical Character
    Recognition Zone on obverse. No personal
    information will be stored on or transmitted via
    RFID
  • Citizenship identifier on face of card
  • Enrolment
  • By appointment at 8 ServiceOntario sites
  • Licensed drivers only
  • Evidence of identity, qualification, and
    citizenship
  • Verification
  • Document scrutiny, system lookup (verify driving
    qualification), and interaction with applicant

EDL Program Features - proposed
  • Fulfilment
  • Once verified, card order sent to DL card vendor
    for production and sent to client
  • Information
  • Information requirements have been determined and
    defined by CBSA/DHS
  • Collect and retain information produced as part
    of transaction
  • Data provided to CBSA under a Memorandum of
    Understanding.  CBSA will disclose this
    information to U.S. border authorities only when
    EDL holders seek to enter the U.S.
  • Legislation
  • Photo Card Act, 2008 has been introduced to
    enable the EDL program

Next Steps
  • Bill has received second reading and has been
    referred to Standing Committee on General
    Government in the fall
  • Opportunity for public input at committee
  • Continue constructive engagement with IPC on the
    file through design and implementation of program
  • Expect implementation in Winter 08/09
  • Expect Photo Card implementation in 2010
