1
Program Implementation Review Resulting from FCC
Orders

Train-the-Trainer Workshop September 17-18,
2001 Schools Libraries Division, USAC
2
Recent FCC Orders
  • From August 2000 to present.
  • Check appeals yourself on the FCC web site
    athttp//www.fcc.gov/ccb/universal_service/
    appeals.html, or http//www.fcc.gov/ccb/universal
    _service/ schoolsandlibs.html

3
Master Mind (8-11-00)
  • FCC supported SLDs denial of funding due to
    material discrepancies between prices presented
by MasterMind and rates offered by actual
    provider.
  • Order gave applicants opportunity to refile
because it appeared they were unaware of the
    irregularities.

4
Brooklyn Public Library (9-26-00)
  • Applicant must prorate 12.6 million in
    nonrecurring costs associated with service
provider infrastructure in a multi-year contract
over a period of not less than three years.

5
Iowa Communications Network (12-26-00)
  • A state-owned network can be an eligible
telecommunications service provider even if it
provides service only to a limited portion of the
public provided that is the only portion it is
legally authorized to serve, it serves that
    portion without discrimination, and customers
    choose content.

6
LA Unified School District(2-14-01)
  • Directs SLD to approve service substitutions if
    (1) same functionality, (2) no increase in price,
    (3) would not violate contract or state/local
laws, (4) no increase in percent ineligible, and
    (5) applicant certifies its consistent with
    470/RFP.

7
Naperville Community Unit (2-27-01)
  • Application should not have been rejected for
failing to meet minimum processing standards
since it was a first-time information requirement
on a revised form, the missing information could
have been reasonably discerned, and the form was
    otherwise substantially complete.

8
Bethlehem Temple Christian School (4-6-01)
  • Applicants must be able to demonstrate they have
the necessary resources to make effective use of
the services for which support is requested.
  • Applicants should not abdicate control over the
    application process.
  • Connectivity much in excess of computers to be
    served can suggest fraud.

9
FCC Deadline Extension (6-29-01)
  • Deadline for delivery and installation of
nonrecurring services is the September 30 that
follows the June 30 close of the relevant funding
    year.
  • If certain decisions (e.g., FCDL, Service
Provider change approved) are issued after March
1, nonrecurring services may be delivered through
September 30 of the following calendar year.

10
Project Interconnect (7-11-01)
  • Consortium leaders should be prepared to submit
to SLD, upon request, Letters of Agency from
    their members.
  • SLD should not deny all funding for a consortium
when only a few members fail to provide Letters
of Agency, but should deny funding for members
for whom it receives no such Letters.

11
Cleveland Municipal School District (8-16-01)
  • File servers are conditionally eligible products.
Eligible servers are conduits for content that
originates elsewhere, rather than sources of
    content.
