  • Unlike the earlier sample forms, the Legal
    Framework
  • Brings practice into line with current Texas Law
that recognizes an educational function not
specifically delegated to the agency is
reserved to and shall be performed by school
districts or open- enrollment charter schools.
  • Focuses on the purpose of the record and
essential critical information to meet state and
    federal requirements, understanding that schools
may include additional items to meet local
    operating procedures.
  • Preserves the schools right to flexibility in
choice of media and format of its records.
  • Supports efforts for empowering parents to
    participate more meaningfully in their
    childrens education.

The practical application of this document is to
provide a checklist to determine if all aspects
are considered as it blends federal regulations
and state statutes. The District Effectiveness
and Compliance (DEC) Reference Guide that is used
to monitor school districts and charter schools
is correlated with the Legal Framework.
