Definitions Regarding SC Law
  • In SC a child means a person under the age of 18

  • When referring to Criminal Acts a child is a
    person under 17
  • Status offense unlawful only for persons under
    18 years old
  • Delinquent act a violation of the law by a
    child, criminal act is committed by an adult

Status Offenses
  • Runaway Leaving home with out permission
  • Gaining admission into a theater by false ID /
    misrepresentation
  • Incorrigible behavior beyond control of parents
  • Truancy Excessive unexcused absence from school

  • Purchase or possession of alcohol under 21

School Offenses
  • Disturbing School interfering or disturbing the
    students or teachers at school including acting
    in a obnoxious manner
  • Interference of the operation of a school bus
    Includes threats of violence and refusing the
    lawful order of the driver
  • Trespassing While enrolled at an alternative
    school, while suspended or expelled or after
    being asked to leave by an administrator
  • Stink bombs or Spray Possession or use of any
    devise containing offensive or foul odors

  • Court Ordered Attendance Paper signed by parent
    and judge that child will attend school
  • If violated parent can pay 50 per day child
    missed school, or 30 days in jail for every day
    missed (contempt)
  • Child may serve up to 90 days at DJJ

Alcohol and Tobacco Laws
  • In SC no person can buy or possess alcohol until
    21
  • Unlawful to use an altered or someone else's ID
    to purchased alcohol
  • Use of fake ID Jail and 1 year suspension of
    DL
  • Unlawful to purchase or sell tobacco to a child
  • Tobacco offenses are considered a status offense

SC Driving Laws
  • Driving without a License once issued a license
    must be in possession when driving
  • Point System 12 points revoked DL if
    restricted or conditional DL 6 points 6 month
    suspension
  • Seat belt every occupant must wear a seat belt.
    Driver responsible for passengers 6-17 year olds

Alcohol and Drug Offenses
  • Possession of Marijuana Jail/Fine and suspension
    of license for at least 6 months any other drug
    at least 1 year suspension of Drivers license
  • Use of fake ID to purchase or posses alcohol
    loss of DL for 90 days and Jail/fine
  • Open container in MV Illegal regardless of age.
  • If convicted of a drug or alcohol offense may
    lose LIFE scholarships or other state funded
    loans and grants

DUI Laws
  • Unlawful for any person to drive a vehicle while
    under the influence of any substance or
    combination of substances that impairs their
    mental and physical ability
  • It is inferred that ability is impaired at .10 at
    21 years old or .02 if under 21 years old
  • Implied consent law a person who drives a car in
    SC has given consent to a breath, urine or blood
    test if arrested for DUI
  • If a person refuses to a test mandatory 6 month
    suspension of license even if found not guilty
  • If test results are .15 or higher at 21 years old
    30 day suspension if under 21 and test results
    are .02 or greater a 3 month suspension is
    mandatory

Employment Laws
  • When you turn 14 you can get certain jobs
    (cashier, office etc.)
  • When you turn 16 you can work in other areas but
    not hazardous jobs. (Heavy Equip. etc.)
  • Cannot work past 7pm on school days or 9pm during
    the summer
  • Under the age of 16 cannot work over 3 hrs. per
    school day for a total of 18 per week
  • During the summer cannot work over 40 hrs a week.
