Reinstatement Rights for Employees Affected in a
RIF
  • An employee affected by a RIF have the following
    rights for one year from the effective date of
    the RIF
  • To apply for any position for which he meets the
    minimum training and experience.
  • To retain continuous service, have sick leave
    restored, and have the option of buying back all,
    some, or none of annual leave at the rate it was
    paid out if reinstated or recalled.
  • If an employee is reinstated to a lower band, he
    will not forfeit recall rights to any position
    within the same competitive area and in the same
    State class title from which he was displaced.

Recall Rights for Employees Affected in a RIF
  • Employees affected by a RIF have the following
    recall rights
  • Employees affected by a RIF have the right to be
    recalled back to any position in the same
    competitive area and same State class title from
    which the employee was separated, involuntarily
    demoted, or reassigned.
  • An employee has recall rights for one year from
    the effective date of the RIF.
  • A State agency is obligated to recall an employee
    in inverse order of layoff based on retention
    points as outlined in the agencys policy.

Grievance Rights of Employees Affected in a RIF
  • Employees affected in a RIF can grieve through
    the agencys grievance procedure and appeal to
    the State Human Resources Director if the
    grievance or appeal is based on inconsistent or
    improper application of a reduction-in-force
    policy or plan.
  • Grievance rights of covered employees cannot be
    exercised until the effective date of the RIF.
