Offer Conditions

• Section I FAR Clause 52.250-1 Indemnification
  under P.L. 85-804
• Subject to Offeror requesting/supporting request
  for unusually hazardous or nuclear risks not
  covered by Price Anderson-Act Amendments (see FAR
  50.403-1 Indemnification Request)
• Approval received from Secretary of Energy
• Signed Performance Guarantee (if applicable)

Standard Form 33

• Authorized representative must have the authority
  to commit the Offeror to the resulting contract,
  fully recognizing that the Government intends to
  make an award without discussions (Block 16)
• By signing, dating and submitting the SF 33, the
  Offeror commits to accept the resulting contract
  as written (Blocks 17 18)
• Any exceptions or deviations by the Offeror to
  the terms and conditions stated in this
  solicitation for inclusion in the resulting
  contract may make the Offer unacceptable for
  award without discussions

Section K

• The Offeror shall submit fully completed Section
  K, Representations, Certifications, and Other
  Statements of Offerors
• The parent organization of each member of a
  teaming arrangement, if proposed, must separately
  complete, sign, and submit the Section K
• Foreign Ownership, Control, or Influence (FOCI)
• Affirmative NNSA Determination required as a
  condition of award
• Facility Clearance
• Personnel Badges
• Organizational Conflict of Interest statement
  must be included as an Exhibit to Section K

Key Personnel

• The Offeror shall submit a complete Listing of
  Proposed Key Personnel utilizing the format
  provided in Section L, Attachment B Listing of
  Key Personnel
• This listing will become part of the Contract as
  an Appendix D to the Contracts Section J
• Key Personnel Resume Elements specified in
  Section L, Attachment D

Small Business Subcontracting Plan

• The Offeror shall submit a Small Business
  Subcontracting Plan for Contract Year One
  (FY2008)
• Contain all the elements required by the Contract
  Section I Clause entitled Small Business
  Subcontracting Plan.
• Section L, Attachment C Instructions for Small
  Business Subcontracting Plan provides a model
  Subcontracting Plan outline and instructions for
  preparing the Subcontracting Plan

Continuous Improvement

• The RFPs Section L evaluation criteria entitled
  Science Technology, Laboratory Operations
  and Business Operations requires the Offeror to
  describe, in part, its proposed approach for
  continuous improvement
• The Offeror shall prepare a listing of its
  planned efforts and expected accomplishments for
  Contract Year 1 and Year 2 (FY 2008 and FY2009)

Continuous Improvement

• The listing will be addressed in the Multi-year
  plan for continuous improvement (See Section H-3
  Clause Contractor Multi-year Strategy for
  Continuous Improvement )
• Performance measures against the listings
  planned efforts and expected accomplishments may
  be considered for inclusion in the PEP for
  Contract Year 1 and Year 2 (FY 2008 and FY2009)
  (See Section L-3, paragraph (h))

Parent Organization Oversight Plan

• The Offeror shall submit a Parent Organization
  Oversight Plan for FY 2008 in Volume I. The
  Parent Organization Oversight Plan will not be
  evaluated for purposes of award.

Transition Plan

• The Offeror shall provide a Transition Plan for
  transition activates identified in Section L,
  Attachment F entitled Transition Plan Guide in
  Volume I. The Transition Plan will not be
  evaluated for purposes of award.
