Title: Fiqh of Tahara7

1
Fiqh of Tahara-7
  • Taught by Hacene Chebbani

2
GhuslRitual Bath
  • What are the actions that obligate ghusl?
  • Discharge of al-mani (semen) whether during sleep
    or wakefulness.
  • Proofs
  • - Hadith Water is required after semen is
    ejaculated (Muslim)
  • - Hadith Umm Sulaim said O Messenger of
Allah! Allah is not ashamed of the truth. Does a
woman have to perform ghusl if she has a wet
dream? He replied Yes, if she sees any
    liquid. (Bukhari/Muslim)

3
Ghusl
  • Notes
  • The discharge has to be caused by desire if the
    person is awake.
  • If the person is sleeping, and he finds wetness,
he has to make ghusl anyway.
  • If the discharge is due to illness or cold, the
person is not required to perform ghusl except in
    the Shafiee school of thought.

4
Ghusl- Notes
  • Aljumhoor (Majority of Scholars) say that Ghusl
is obligatory if two conditions are there
  • - The discharge is caused by desire.
  • - The fluid is ejected.
  • Al-mani (Semen) has three signs
  • - It is ejected
  • - It has the smell of eggs if it is dry, and the
smell of clay or pollen when it is wet.
  • - The body is relaxed/tired after the discharge.

5
Ghusl- Notes
  • If someone had a sexual dream, but does not find
any wetness on his clothes, then he does not have
    to make ghusl.
  • If someone finds wetness on his clothes, but does
not remember any dream, then he has to make ghusl
if he thinks that the discharge is semen.
    (through its odour).
  • - If he believes that the discharge is not
semen, then he does not have to make ghusl and
needs to treat it as a madhy (prostatic fluid)

6
Ghusl-Notes
  • If he could not reach a conclusion, whether it is
semen or madhy, then if he remembers a dream, he
has to make ghusl. If he did not have any dream,
but he thought about getting together with his
wife before going to bed, then he has to treat it
    as a madhy.
  • If none of the above happened, then he has to
make ghusl to be in the safe side based on one
legal opinion. Based on the second one, he does
    not have to.
  • Conclusion To be in the safe side, he should
    make ghusl.

7
Ghusl
  • Proofs that emission of semen due to sickness or
    cold does not require ghusl.
  • The ayah And if you are in a state of
Janaabah, purify yourselves (bathe your whole
    body). Al-maaidah6
  • - Analysis The one who is in state of Janaabah
    is called Junub.
  • - Junub in Arabic refers to the one who has
emitted semen which gushes forth combined with
    feelings of pleasure.

8
Ghusl
  • Gushing forth is taken from the ayah in surah
Tariq So let the man see what he is created
from. He is created from a water gushing forth
    At-Tariq 5-6
  • 2. The hadith Allahs Messenger told Ali
..but if water gushes out maniy or semen, then
do ghusl (Ahmed/Abu Dawood/Nasai and it is
    saheeh).

9
Ghusl
  • Sexual intercourse, even if ejaculation does not
    take place.
  • Proof
  • - The hadith of Abu Huraira that the prophet
(pbuh) said When a person sits between the
four parts of her body and exerts himself (has
intercourse), ghusl becomes obligatory, even if
    he does not ejaculate. (Muslim)

10
Ghusl
  • When a disbeliever embraces Islam.
  • Proof
  • - The hadith of Qays ibn Aasim that he accepted
Islam and the prophet (pbuh) commanded him to
make ghusl with water and sidr.
    (Nasaai/Tirmithi/Abu Dawood). It was classified
    as sahih by Alalbaani.

11
Ghusl
  • At the end of menstruation and post-childbirth
    bleeding.
  • Proof
  • - The hadith of Fatima bint Abi Hubaish that
the Prophet (pbuh) told her When your menstrual
period comes, leave prayer, and when you finish
it, make ghusl and pray. (Bukhari 320)
  • - By consensus of all learned scholars that the
same ruling is applied to the post-childbirth
    bleeding.

12
Pillars of Ghusl
  • Intention (Niyyah)
  • Proof Hadith Verily, deeds are purely
    according to intentions (Bukhari/Muslim)
  • Washing the whole body
  • Proof Ayah nor when you are junub, unless
you are passing by until you have made ghusl
    443
  • Meaning Do not approach the salah when you are
junub until you make ghusl which means in Arabic
washing the whole body. Thus water should reach
    and flow over every organ.

13
How do we Perform Ghusl?
  • The description of his ghusl (pbuh) is found in a
    couple of hadiths
  • The hadith of Aisha that she said When
Allahs Messenger (pbuh) made ghusl from
janaabah, he used to begin by washing his hands,
then he would pour water from his right hand to
his left and wash his private parts, make the
ablution of prayer, take some water and put his
fingers to the roots of his hair, until he could
see that the skin was wet, then he would pour
water over his head three times and then over the
rest of his body. Then he would wash his feet
    (Bukhari/Muslim).

14
How do we Perform Ghusl?
  • The hadith of Maimounah , that she reported I
placed water of the Prophet (pbuh) to take a
bath. He poured water over his hands, and washed
them twice or thrice. Then he poured water with
his right hand over his left one and washed his
private parts. He rubbed his hand over the earth
(and washed it). He rinsed his mouth and washed
his nose by putting water in it and blowing it
out. He washed his face and forearms, then his
head three times. He poured water over his body
and withdrew from that place and washed his feet.
I brought him a piece of cloth (towel), but he
returned it. He (only) shook water off with his
    hand. (Agreed upon)

15
Description of the Complete Ghusl
  • He intends in his heart to remove the major
    impurity.
  • He says bismillah, washes his hands three
times, washes his private parts and then clean
his hands. (with soap if he wishes).
  • He makes wudu but leaves his feet till the end.
  • He pours water on his head three times and make
sure that the skin of his head is wet.
  • He washes the whole body while rubbing it with
his hands and then he washes his feet.

16
Important Notes for Women
  • When making ghusl, women do not need to undo
    their braids.
  • Umm Salamah said O, Messenger of Allah
(pbuh)! I am a woman who has closely plaited hair
on her head. Do I have to undo it in order to
make ghusl due to janaabah? He (pbuh) said No,
it is enough for you to throw three handfuls of
water over head and then pour water over
yourself. After doing this you will be cleansed.
    (Muslim/Abu Dawood and others).

17
Important Notes for Women
  • A group of scholars believe that the above
mentioned concession is only applied to ghusl
from Janabah, but when she makes ghusl due her
menses which occurs only once a month, then she
has to undo her braids and rub her head very
    well.
  • Another group of scholars believe that this
concession is applied to all types of ghusl.
  • Conclusion Be on the safe side and undo your
braids when you make ghusl after your menses are
    over.

18
Other Points of Concern
  • There are two options concerning washing the
feet, either we do them with the wudu or leave
    them till the end.
  • We have to wash in between the toes.
  • If semen comes out, after we finished making
ghusl. Do we have to make another ghusl? Answer
No, we do not have to do another ghusl, unless it
came out gushing forth due to another desire.

19
Other Points of Concern
  • If semen was about to come out, but it did not
for whatever reason, then no ghusl is required.
  • Mere touching between the two organs does not
necessitate ghusl. Any degree of penetration,
    however, makes ghusl obligatory.

20
Other Points of Concern
  • If semen is found on the clothes after he had
already prayed and if he can not recall when it
came out, he should make ghusl and then perform
all the prayers due since he last went to sleep.
  • If, however, it can be recalled that ejaculation
took place even prior to the last sleep, then all
the prayers due since then should be done again.

21
Other Points of Concern.
  • It is recommended for the junub to make wudu if
he wants to eat, drink or go to bed.
  • The hadith of Aisha that the prophet (pbuh)
would make wudu, if he wanted to eat or sleep
while in a state of janabah (Muslim)
  • 8. There is no need to make wudu after an
obligatory ghusl. However, if the ghusl is
desirable then one needs to do wudu after his
    bath.

22
Desirable Types of Ghusl
  • It is highly recommended to make ghusl before
    going to Jumaah prayer.
  • It is recommended to make ghusl after washing the
    body of a deceased person.
  • Hadith Whoever washed a dead body should make
    ghusl (Ahmed/Ibn Majah and others)
  • Making ghusl for Hajj and Umrah. Zaid bin Thaabit
said that he saw the Prophet (pbuh) making ghusl
when he intended to perform Hajj (Tirmithi)

23
Desirable Types of Ghusl
  • Making ghusl upon entering the city of Makkah.
Abdullah ibn Umar used to do it and said that the
Prophet (pbuh) used to do it. (Muslim/Abu
    Dawood)
  • Making ghusl for the two Eid Prayers. Ali bin
Abee Talib was asked about ghusl, so he said
Make ghusl on Fridays, on the Day of Arafa, the
Day of Ad-adha, and the Day of Eid Alfitr
    (Albayhaqi)

24
Desirable Types of Ghusl
  • Making ghusl after losing consciousness.
  • Allahs Messenger (pbuh) made ghusl after he
fainted when he was sick before joining the
congregational prayer. This event took place
right before he passed away. (Bukhari/Muslim)

25
Forbidden Acts for the Junub.
  • A person who is junub should not, without making
    ghusl do the following
  • Perform Salah
  • Go around the Kabah
  • Recite the Quran
  • Stay in the Masjid. (He may pass by or stay in it
    if he makes wudu)
  • Carry or touch the Mushaf.
