- 552.216-70 Economic Price Adjustment FSS MAS
Contracts (SEP 1999)(ALT I SEP 1999)(DEVIATION
I APR 2007) - Contractors may request price increases providing
the following are met - Increases result from increase in commercial
price upon which contract award was predicated - Increase requested before the last 60 days of the
contract and - 30 days elapse between requested increases
6Economic Price Adjustments
- The Government reserves the right to
- Accept the price increase as requested
- Negotiate more favorable discounts from the new
commercial list price or - Remove the affected products from the contract if
the increase is not supported
7Price Reductions
- 552.238-75 Price Reductions (May 2004)
- Price reductions must be reported when the
contractor - Revises the commercial price upon which contract
award was predicated - Grants more favorable discounts and/or terms and
conditions to the tracking customer negotiated at
time of contract award - Grants special discounts to the tracking customer
and the change disturbs the tracking ratio - The contractor may offer Government-wide
voluntary price reductions at any time throughout
the contract
8Price Reductions
- Vendors are not required to notify the Government
of price reductions for sales - To commercial customers for firm fixed-price
definite quantity contracts in excess of the
maximum order threshold for the SIN(s) awarded - To Federal agencies
- To State and Local governments under this
contract (when these entities form the tracking
customer) or - Caused by error in quotation or billing (provided
adequate documentation is provided to the
Contracting Officer)
9Price Reductions
- The contractor must notify the Contracting
Officer within 15 calendar days of the effective
date of the price reduction - A modification request must be submitted for all
price reductions
10Tracking Customer
- TRACKING CUSTOMER
- Established at time of contract award, the
tracking customer is a commercial customer or
category of customer that is tracked against the
awarded FSS pricing - TRACKING RATIO
- Mathematically represents the relationship
between the awarded FSS price and the tracking
customer price -

- Price reductions effective when offered to any

GPO. Reductions to other commercial customers do
not invoke the Price Reductions clause.
