3 - TSN law defined precisely the role of the
Government and ASN regarding licensing
procedures, in summary - By decree or order, the Government defines the
general regulations applying to nuclear
activities. It takes a limited number of key
individual decisions concerning the major nuclear
installations (INB), in particular creation and
dismantling authorisations. It is responsible for
civil protection in emergency situations - ASN is in charge of supervising nuclear
activities both within INB and small-scale
nuclear installations (industrial installations,
research lab and medical installations using
ionising radiation). - ASN has to be consulted about the drafts of
regulatory decrees and orders issued by the
Government and may itself issue regulatory
decisions to clarify these decrees and orders - ASN takes individual decisions concerning nuclear
activities (for example authorisation to use
radioactive material transport packaging,
authorisation to use a radioactive source, etc.)
and may impose individual requirements on the
licensees. - ASN is responsible for inspection and may
pronounce sanctions, in particular suspension of
operation of an installation - ASN organizes a permanent watch on radiation
protection and assists the Government in case of
an emergency - ASN is responsible for contributing to the public
about nuclear safety and radiation protection.
4 - Regulation of INB (TSN law) the law of June
13th, 2006 defines a creation authorisation,
followed by a series of authorisations during the
different stages of the life of the INB
creation, operation, possible modification,
shutdown and dismantling. - Safety options
- Site selection
- Creation authorisation (given by governmental
decree) - Public consultation
- Constitution of a local Committee for Information
(CLI) - Consulting of the Technical Support Organisations
- Decree of creation authorisation
- Possible modification of the installation
- Case of the installation classified for the
protection of the environment. - Operation authorisation (given by ASN)
- Authorisations for shutdown and dismantling
(given by governmental decree) - The technical prescriptions defined by ASN for
the governmental decrees.
5 - Safety options
- When an operator intends to construct an
installation of a new type , it presents to ASN
as early as possible, early before asking
authorisation, the safety objectives and the main
characteristics of the installation - ASN requests its technical support organisation
to make the assessment and consequently informs
the Operator about the issues it should take into
account in its request for authorisation - This preparatory procedure does not replace the
further regulatory steps but aims at facilitating
them - A good example EPR.
6 - Site selection
- Early enough before applying for the creation
authorisation, the Operator informs the ASN about
the site(s) in which it intends to construct the
installation - Social and economic aspects and safety are
examined - If the installation is intended to produce
energy, DGEMP is strongly involved in this
assessment - ASN examines the site(s) characteristics related
to safety external hazards (e.g. earthquake),
hydrology, industrial environment, availability
of cooling sources, etc. - Public debate mandatory if it is a new site for
an NPP or a new site not intended for an NPP but
if which the cost is higher than 300 M - Possible public debate if it is a new site not
intended for an NPP and of which the cost is
between 150 M and 300 M - Public debates have been organised in 2006 for
the construction of EPR at Flamanville and the
implementation of the research reactor ITER at
Cadarache.

9 - Authorisation procedure for shut down and
dismantling - Authorisation mandatory
- Public inquiry is necessary in all cases
- Two regimes of authorisations are possible
depending if it is a general case or if it
concerns an installation for radiactive waste
disposal - General case
- the application for the authorisation includes
the measures related to the conditions of shut
down, the dismantling and waste management
modalities, and to the monitoring and the keeping
of the place of the installation, - The authorisation is given by a governmental
decree, after ASN opinion, defining the
characteristics of the dismantling, its duration
and the types of operations to be executed by the
operator after the dismantling. - Installation for radioactive waste disposal
- the application includes the measures related to
the final shut down as well as to the keeping and
monitoring of the site. - the authorisation is given by a governmental
decree, after ASN opinion, defining the types of
operation of which the operator will be in charge
after the final shutdown.
