Applicability
  • These requirements apply to a site which
  • Will not be developed within three years after
    timber removal.
  • Is one (1) acre in size or larger and 5,000 sq ft
    or more of the tree canopy is going to be
    harvested, cut, or removed within a 1 (one) year
    period, or
  • Is having timber harvested, cut, or removed for
    the purposes of conducting Forestry Land
    Management Practices.

Exemptions are granted if undue hardship can be
proven.
  • Such applications shall be made to the Municipal
    Forester and shall show
  • 1. Special conditions peculiar to the property
    that cause the undue hardship
  • 2. How enforcement of the rules will deprive the
    landowner of rights commonly enjoyed by others in
    similar areas
  • 3. That the granting of the modification will not
    confer on the landowner a special privilege that
    would be denied to other applicants
  • 4. That the modification request is not based on
    conditions or circumstances that are the result
    of actions by the applicant
  • 5. That the request does not arise from a
    condition relating to land or building use,
    either permitted or legally nonconforming, on a
    neighboring property and
  • 6. The granting of a modification will not
    adversely affect water quality.

Timber Removal Permit
  • The permit is good for 180 days for cutting,
    removal, or harvesting timber and is effective
    for another 12 months for re-vegetation. If
    removal activity is not complete during the 180
    days, a new permit must be applied for. One
    permit extension of up to 90 days may be granted
    by the Municipal Forester.

Revegetation Plan
  • The Revegetation Management Plan shall identify
    and demonstrate the following
  • The location of the mandated 50 undisturbed
    buffer around the perimeter and any other tree
    protection areas, including types of existing
    vegetation and trees.
  • Location of Tree Removal Areas.
  • Location of revegetation areas and types of
    trees/vegetation to be planted.
  • The method used to regenerate the tree removal
    area.
  • Contours of land in 10 foot increments.
  • Location of watercourses.
  • Additional info as required by the Inspection
    Department or the Municipal Forester.

  • Revegetation of the site must be completed within
    12 months of the timber removal.
  • Tennessee Division of Forestry BMPs must be
    utilized.
  • The use of a Master Logger is highly encouraged.
  • At the completion of revegetation an inspection
    must be requested.

Permit Fees
  • 30 per acre with 100 minimum.
  • 5.00 Administration Fee (non-refundable)
  • 10.00 Technology Fee (non-refundable)
  • After satisfactory completion of the required
    re-vegetation the surety bond will be released.
    Surety bond can be in the form of a Letter of
    Credit or a Cashiers Check.
