    likely, not.

  • Dismissal available remedy ultimately.
  • Innocent not disciplinable
  • Contractual right to exhaust leaves, WCC, etc.
  • Allegations of discrimination likely.
  • Duty to accommodate employee, if practicable.
  • Can terminate ultimately for failure to perform.
